Vaihtokaista – Terms of Use

1. Palvelu ja ehtojen hyväksyminen

These terms apply to the service operated at vaihtokaista.fi. The service is intended for publishing sale listings for cars, searching for cars, and contact between buyers and sellers in Finland. The sale of spare parts, other goods or services is not part of the service.

By creating an account or using the service, you agree to comply with these terms. If you do not accept the terms, do not create an account or continue using the service. These terms do not replace the contract of sale between the buyer and seller.

2. Maksuton käyttö ja palvelun rooli

A user account, business account, publishing car listings, searching and messaging are free of charge. Vaihtokaista does not charge monthly fees, listing fees or commission, and no payment card is required to use the service. The car’s sale price and any registration, insurance and other costs of the transaction are the responsibility of the parties.

Vaihtokaista provides a listing service and is not the seller, buyer or broker of any car sale. The transaction is made directly between buyer and seller. Vaihtokaista does not receive sale prices, process payments, arrange finance or guarantee that a sale will be completed.

3. Käyttäjätili ja yrityskäyttäjät

An account can be created with an email address and password or with a Google account. The account holder must be at least 18 years old. Provide accurate details, keep them up to date and protect your login details. Impersonating another person or company, and bypassing restrictions by using multiple accounts, is prohibited.

Anyone acting on behalf of a company must have the right to represent that company. For a business account, provide the company name, Business ID (Y-tunnus), and the requested contact and address details. A seller operating as part of a business must use a business account so that the buyer can see the seller’s status. The seller’s legal status is determined by the actual activity.

4. Autoilmoitusten julkaiseminen

Only publish a listing for a car you have the right to sell. Use a clear title, up-to-date details and images that you have the right to publish. Do not create duplicate listings for the same car or add irrelevant keywords.

The listing is submitted for review and becomes public after approval. Changes may also require a new review. Approval is not an inspection of the car’s condition or a guarantee that the information is correct. The seller is responsible for the content shown in the listing.

Keep the listing up to date. Mark a sold car as sold or remove the listing when the car is no longer available. Vaihtokaista does not guarantee any particular visibility, number of enquiries or selling time for a listing.

A published listing is valid for 60 days. You will receive a reminder one week before it expires and can extend it free of charge. An expired listing is removed from search, and it can be republished without a new review for 30 days.

5. Auton tiedot ja myyjän vastuu

The seller must state the car’s essential details correctly:

• Make, model, model year, fuel type and registration number.
• The actual mileage. A replaced odometer or uncertainty about the reading must be stated clearly.
• Inspection status, registration status, taken out of traffic use and any driving or use ban.
• Known faults, significant damage, essential repairs and other matters affecting the buyer’s decision.
• Hire purchase debt, finance company ownership, retention of title and other encumbrances affecting the sale. Any necessary consents must be obtained before the sale.
• Sale price and any mandatory additional costs. A business seller’s price shown to a consumer must include applicable taxes.

The seller and buyer are responsible for the bill of sale, handover, change of ownership, insurance and taxes. The buyer must register the change of ownership within seven days. The seller is advised to submit the transfer notification immediately after the sale.

A stolen car or a vehicle defined as waste under the Waste Act must not be offered on the service. A waste vehicle belongs at an appropriate reception point.

Check the car’s details, the seller’s right to sell the car and the car’s condition before buying. Agree the price, payment method, handover time and any known faults in writing. The seller must make sure payment has been received before handing over the car and keys.

When buying as a consumer from a business, the Consumer Protection Act applies. A business seller is liable for defects as provided by law. If the sale meets the conditions for distance selling, the buyer usually has a 14-day right to cancel from receiving the car. Simply finding the listing online does not make the sale distance selling.

Sales between private individuals are governed by the Sale of Goods Act. There is no right of cancellation under the Consumer Protection Act, but the seller may still be liable for incorrect information, concealment of essential details and other defects under the Sale of Goods Act. A statement that the item is sold ‘as is’ does not automatically remove liability.

Claims concerning the car and the sale should be made to the seller. Claims concerning Vaihtokaista’s own service should be made to the administrator.

7. Kielletty sisältö ja toiminta

• Fraud, phishing and misleading listings.
• Offering stolen cars or illegal content.
• Tampering with the odometer or car identification details.
• Unauthorised publication of other people’s personal data, and infringement of images, texts or other rights.
• Harassment, threats, discrimination and hateful content.
• Spam, account abuse, disruption of the service, and bypassing security or usage restrictions.

Automated use must not burden the service, collect private information or bypass access control. Normal search engine indexing of public pages is allowed in accordance with the service’s indexing guidance.

8. Viestit ja hakuapuri

Use messages for proper communication related to car listings. Messages are stored in the service in accordance with the privacy policy. Do not send bank credentials, payment card details or unnecessary personal identity numbers. Keep the details agreed in the sale for your own records as well.

The AI-powered search assistant helps you build search criteria and may ask for clarification. It may misunderstand your request and does not verify the car’s condition, the accuracy of the listing or whether the car suits you. Check the search criteria and the listing before making contact.

The search text and clarifications entered into the search assistant are sent to OpenAI for processing. Do not enter sensitive information. You can make at most three separate searches per hour with the search assistant. Technical rate limits may be used in the service to prevent abuse.

9. Hakutulosten järjestys ja näyteikkuna

Search results are filtered according to the chosen search criteria. The default order is newest published listing first. You can also sort results by update time, price, model year, mileage, distance or views. Distance sorting requires a starting location for the search. In the event of a tie, the order is determined by the listing ID.

The latest listings on the home page and the showcase are separate highlights. A listing selected for the showcase therefore does not get priority in the actual search results. Paid visibility that affects search ranking is not sold.

10. Sisällön tarkistus ja käyttörajoitukset

The administrators review listings submitted for publication. The service also uses form checks and technical safety limits. The administrators may reject or remove content that breaches the law or these terms, and restrict an account used for abuse. Any action must be proportionate to the breach.

Illegal content or abuse can be reported to the administrator through the contact channel in section 16. Provide the exact address of the listing or other content, the reason for the report and any evidence. Include your contact details so a response can be given about how the report is handled.

Where content or an account is restricted, the user will be given reasons and information on the available remedies as required by law. You may ask the administrator to reconsider the decision. Serious abuse or an order from a public authority may be acted on immediately.

11. Sisällön käyttöoikeudet

You retain the rights to your own images and texts. You grant Vaihtokaista a free, non-exclusive right to store and display your content in the service and to process it technically, such as resizing images. This right covers the technical service providers used by the service. Under this term, your content will not be transferred for separate advertising use.

Public listings may appear in search engines and in answers from AI-based search services. Removing a listing does not immediately remove cached copies from search services. After removal, content is retained only to the extent permitted by the privacy policy and law, for example for backups or legal claims.

Rights related to the service’s software, marks and visual design belong to the administrator or other rights holders.

12. Tietosuoja ja käytön lopettaminen

The processing of personal data, the service providers used and cookies are described in the privacy policy. Accepting the terms is not consent to voluntary marketing or analytics cookies.

You can stop using the service at any time and manage your own listings in your account. You may request the deletion of your account or personal data from the administrator. Deletion requests are handled in accordance with data protection law. Necessary data may be retained because of legal obligations or legal claims. Closing an account does not remove obligations between buyer and seller.

13. Palvelun saatavuus ja vastuu

The service is maintained and developed, but uninterrupted operation or error-free performance is not guaranteed. Maintenance, telecommunications disruption or a security issue may cause a temporary outage.

The user is responsible for their own content and their own transaction. The administrator is responsible for its own actions in accordance with applicable law. The service being free of charge does not in itself remove any statutory liability of the administrator.

These terms do not limit rights arising from mandatory law, or liability for damage caused intentionally or by gross negligence.

14. Ehtojen muutokset ja yrityskäyttäjien oikeudet

The terms may be updated, for example if the service’s operation or legislation changes. Material changes will be notified in advance in the service or by email. The notice will state the nature of the change and when it takes effect. You may stop using the service before the change takes effect. These terms do not set any future fees.

For business users, changes to the terms will be notified in a durable format at least 15 days in advance, or longer if necessary. Any restriction of a business user’s service will be explained. Termination of the entire service relationship will usually be notified at least 30 days in advance. These time limits may be departed from only where permitted by applicable law, such as where required by a statutory obligation.

Business users may use other sales channels and price their cars independently there. Their own listings and contacts can be managed from the account. The administrator has access to service data as required for its duties; disclosures are described in the privacy policy. Once the account is closed, access to the account ends. A business user may request their own personal data in accordance with the privacy policy and make a complaint about the service to the administrator.

15. Sovellettava laki ja riidanratkaisu

Finnish law applies to these terms. Any dispute concerning the service will first be sought to be resolved with the administrator. Any dispute concerning a car sale will be resolved between the buyer and seller.

In a dispute between a consumer and a trader, the consumer may contact to consumer advice and bring the matter to the Consumer Disputes Board for consideration within its jurisdiction. They do not handle car sale disputes between two private individuals.

The matter may also be referred to a competent court. The consumer’s statutory right to bring proceedings in the court of their place of residence is not restricted.
